Terms of Service & Conditions
Effective Date: January 1, 2026. Governing regulations, computational variance tolerances, and limitation of structural liability for civil and residential material estimation.
1. Nature of the Calculation Services
AggregateYard provides mathematical estimation algorithms based on theoretical geometric displacement and standard dry quarry bulk densities. The generated outputs are strictly for informational planning purposes.
Outputs represent baseline volumetric approximations and do not constitute a formal, certified stamp from a licensed Professional Engineer (PE) or licensed civil surveyor. Users are solely responsible for independently verifying all final material orders with local suppliers prior to execution.
2. Jobsite Physical Variances & Mandatory Overpour Allowances
By utilizing these calculation tools, users acknowledge physical site conditions invariably alter finished volume requirements from theoretical geometric calculations:
- Subgrade Deflection & Trench Over-Excavation: Soil subgrades compress and flex under heavy wet mix, increasing volume demand by 5% to 10%.
- Formwork Bowing: Wooden form stakes and 2x4 lumber deflect outward under hydrostatic concrete pressure.
- Ready-Mix Drum Residuals: Transit mixers typically retain between 0.25 to 0.5 cubic yards of residual paste adhering to internal drum fins.
- Material Compaction: Granular road bases (such as Crusher Run 21A or Dense Grade) compact by 12% to 15% under vibratory rolling operations.
3. Limitation of Commercial & Structural Liability
AggregateYard explicitly disclaims any and all liability regarding commercial project delays, structural defects, or financial damages, including but not limited to:
- Batch plant minimum load fees, short-load delivery surcharges, or truck waiting time fees incurred by the user due to underestimation.
- Cold joints or structural cracks resulting from under-ordering concrete or premature setting during delivery delays.
- Weight-ticket discrepancies at quarry weighbridges caused by stockpile moisture saturation or scale tare variances.
All services are provided strictly "AS IS" and "AS AVAILABLE". To the maximum extent permitted by applicable law, AggregateYard limits aggregate liability for any claims arising from the use of the platform.
4. Intellectual Property & Algorithmic Ownership
AggregateYard retains all proprietary rights over the custom calculation scripts, multi-zone polygon accumulation logic, interactive UI design components, and compiled documentation contained within the platform.
Users are granted a limited, non-exclusive, revocable license to generate project estimates, copy the Bill of Materials (BOM), and print job sheets for personal or commercial contractor use. Automated scraping, data extraction, or reverse engineering of the mathematical algorithms is strictly prohibited.
5. Modifications, Jurisdiction & Governing Law
Terms of Service may be updated periodically to reflect revised ASTM civil standards or operational guidelines. Continued use of the platform following modifications constitutes binding acceptance of those changes. Standard severability clauses apply, and disputes shall be governed by the laws of the applicable jurisdiction without regard to conflict of law principles.
